Summary

New York’s Transfer on Death (TOD) Deed statute marks a significant development in real property practice. This CLE will examine the statutory requirements and practical implications of using TOD Deeds to transfer residential real property outside of probate. Topics will include eligibility, execution and recording requirements, revocation, creditor rights, tax considerations, and potential title issues. Presenters will also address bankruptcy considerations, as well as the impact of TOD Deeds on estate and long-term care planning including Medicaid eligibility, estate recovery, and recommended asset protection strategies.
