Summary

This CLE course provides an in-depth analysis of the 2024 amendments to New York State's Department of Motor Vehicles (DMV) regulations, focusing on significant changes to the point system and heightened penalties for alcohol- and drug-related offenses. Led by a judge, prosecutor, and defense attorney, the session will explore the implications of the new rules from all angles of the criminal justice system. The course will cover the "Forfeit After Four" rule, which mandates permanent license revocation after four alcohol related driving conviction or three such incidents combined with other serious offenses. Additionally, the course will examine the extension of the point accumulation period from 18 to 24 months, the introduction of 11-point penalties for Driving While Intoxicated and related offenses, and the increased financial burdens imposed by the Driver Responsibility Assessment fees. The course will also cover the ethical implications of these new rules including the role of the prosecutor, defense attorney, and judge.
