Event Description:

In two significant decisions handed down in June, the U.S. Supreme Court addressed efforts at fostering diversity, finding in both cases that the Constitution limits what can be done to do so. In 303 Creative v. Elenis, the Court held that the First Amendment prohibits Colorado from forcing a website designer to create expressive designs speaking messages with which the designer disagrees. In two cases brought by Students for Fair Admissions challenging affirmative action admissions programs at Harvard and the University of North Carolina, the Court held that the two programs violated the Equal Protection Clause of the 14th Amendment. Join our panel of experts for a review of these decisions and an exploration of what they mean for the future of Constitutional law as it relates to public accommodations law, affirmative action, and other efforts at fostering diversity, equity, and inclusion.
