Summary

Any practitioner who has filed a petition seeking an order of consent, allocation or distribution following the resolution of a wrongful death claim knows that these petitions can be complex and raise procedural, substantive and practice management issues. Please join Monroe County Surrogate Court Judge Ciaccio for a discussion of many of these issues including: (1) insight on how the court determines a settlement is reasonable, (2) allocating settlement funds between wrongful death and conscious pain and suffering, (3) the resolution and payment of liens, including Medicare and Medicaid liens, (4) the use of a Guardian Ad Litem, (5) the impact of confidentiality agreements on the content of petitions, (6) payment of fees to settle the estate, and (7)the application of the Kaiser formula to determine distributions among distributees.
